Trump and Netanyahu: Both Being Investigated for Made-Up Crimes

There are striking similarities, as well as important differences, between the investigations being conducted against American President Donald J. Trump by the US Congress, and Israeli Prime Minister Benjamin Netanyahu, who was just indicted.

The most striking similarity is that both are being investigated for actions that their legislatures have not explicitly made criminal. Moreover, no legislature in any country governed by the rule of law would ever enact a general statute criminalizing such conduct. The investigations of these two controversial leaders are based on using general laws that have never previously been deemed to apply to the conduct at issue and stretching them to target specific political figures.

Netanyahu has been indicted for bribery on the ground that he allegedly agreed to help a media company in exchange for more positive coverage and/or less negative coverage. There are disputes about the facts, but even if they are viewed in the light least favorable to Netanyahu, they do not constitute the crime of bribery.

Nor would the Knesset ever enact a statute making it a crime for a member of Knesset to cast a vote in order to get good media coverage. If such a law was ever passed, the entire Knesset would be in prison. Politicians always seek good coverage and many vote with that in mind. Some even negotiate good coverage in advance of voting. That is why they have press secretaries and media consultants.

Trump y Netanyahu están siendo injustamente perseguidos

En las investigaciones que se están llevando a cabo el Congreso de EEUU contra el presidente estadounidense, Donald J. Trump, y en los tribunales israelíes contra el primer ministro del Estado judío, Benjamín Netanyahu, hay llamativas semejanzas, así como importantes diferencias. La más sorprendente de las primeras es que ambos están siendo investigados por actos que el legislador de ambos países no considera explícitamente delictivos. Es más, ningún Legislativo de ningún país sometido al imperio de la ley promulgaría una norma general que penalizara tales comportamientos.

Las investigaciones de que están siendo objeto esos dos controvertidos líderes se basan en el uso de leyes generales que nunca antes se habían considerado aplicables a ese tipo de comportamientos, y en estirarlas para atacar a precisamente a esos dos controvertidos líderes.

Netanyahu ha sido acusado de soborno porque supuestamente accedió a ayudar a una empresa mediática a cambio de una cobertura más positiva o menos negativa de su gestión. Hay cierta discusión sobre los hechos, pero aun considerados de la forma menos favorable a Netanyahu no constituyen un delito de soborno.

La Knéset jamás promulgaría una norma que convirtiera en delito el hecho de que un diputado vote de tal o cual manera para ganarse el favor de los medios. Si llegara a aprobarse, toda la Knéset acabaría en la cárcel. Los políticos siempre cortejan a los medios, y muchos votan teniendo eso bien presente. The new resolution will be asking the United Nations to recognize the 800,000 Jewish refugees from Arab countries and Iran

Israeli Ambassador to the United Nations, Danny Danon, will announce later today (Tuesday) his intention to file a resolution recognizing Jewish refugees from Arab countries, The Jerusalem Post has learned.

Danon will announce the resolution during a General Assembly discussion to mark 72 years since the November 29 partition plan.

During the event on Tuesday, the Palestinian representative to the UN is said to introduce a series of pro-Palestinian resolutions, including a resolution supporting the Palestinians’ right of return. A similar session with similar resolutions will be taking place every year.

El embajador israelí en las Naciones Unidas, Danny Danon, anunciará hoy (martes) su intención de presentar una resolución que reconozca a los refugiados judíos de los países árabes, según ha sabido The Jerusalem Post.

Danon anunciará la resolución durante una discusión de la Asamblea General para marcar 72 años desde el plan de partición del 29 de noviembre.

Durante el evento del martes, se dice que el representante palestino ante la ONU presenta una serie de resoluciones pro-palestinas, incluida una resolución que apoya el derecho de retorno de los palestinos. Una sesión similar con resoluciones similares se llevará a cabo cada año.

Según la Misión israelí ante la ONU, la nueva resolución, que pide a las Naciones Unidas que reconozcan a los 800,000 refugiados judíos de países árabes e Irán, tiene como objetivo socavar las resoluciones palestinas propuestas.
